DOJ Sues Tennessee Over Law On Prostitutes With HIV

The U.S. Department of Justice (DOJ) filed a lawsuit against the state of Tennessee and the Tennessee Bureau of Investigation (TBI) Thursday, alleging the Volunteer State’s law against aggravated prostitution, which places stronger punishments for exposing others to HIV, violates the rights of people living with HIV by discriminating against them based on their HIV status alone.

The Justice Department argues in its lawsuit that the enforcement of an aggravated prostitution law in Tennessee constitutes a violation of federal law. The DOJ says issuing harsher criminal sentences to criminals who expose others to HIV while exchanging lewd favors for money violates the Americans with Disabilities Act (ADA).

“The department previously notified Tennessee and the TBI that they violated the ADA by enforcing the state’s aggravated prostitution statute against people living with human immunodeficiency virus (HIV),” the DOJ wrote in a press release. “That letter of findings detailed the minimum remedial measures necessary to address the discrimination.”

“The enforcement of state criminal laws that treat people differently based on HIV status alone and that are not based on actual risks of harm, discriminate against people living with HIV,” said Kristen Clarke, assistant attorney general of the Justice Department’s Civil Rights Division, in a statement for the DOJ’s announcement.

“People living with HIV should not be subjected to a different system of justice based on outdated science and misguided assumptions,” Clarke said. “This lawsuit reflects the Justice Department’s commitment to ensuring that people living with HIV are not targeted because of their disability.”

“Tennessee’s aggravated prostitution statute elevates what would otherwise be misdemeanor conduct to a felony because the individual has HIV, regardless of any actual risk of harm,” the Justice Department said.

“Aggravated prostitution is also categorized as a ‘violent s—ual offense’ mandating registration by those convicted on the Tennessee Sex Offender Registry, in most cases for life,” the DOJ added. “The state maintains the registry through the TBI.”

Conservatives panned the Justice Department’s move online.

“You could lose your job if you don’t get the jab but you can give the HIV at your leisure,” Dana Loesh wrote on X, formerly Twitter.

“The Biden DOJ just sued Tennessee for making it a crime to knowingly transmit AIDS and HIV. They claim it violates disability rights. No, I am not kidding,” wrote End Wokeness.

Questions surround the political action committee (PAC) associated with the primary BLM organization. Federal Election Commission (FEC) records showed that BLM spent the majority of its 2023 expenses paying the consulting firm owned by the treasurer of the PAC.

Black Lives Matter PAC paid $90,000 to Bowers Consulting Firm in 2023 for “strategic consulting services,” according to FEC disbursement filings. Shalomyah Bowers is both the treasurer of Black Lives Matter PAC and the founding president of Bowers Consulting Firm.

The twist is that, according to the FEC, treasurers like Bowers who handle the disbursement of funds for these super PAC organizations have legal authority to spend as they see fit. Bowers has her hands in both cookie jars when it comes to the BLM PAC and her own consulting firm.

FEC filings showed that Bowers Consulting Firm received about 61% of the $146,679 Black Lives Matter PAC spent in 2023. Much of the rest of the PAC’s expenses went to items such as legal fees, compliance services, payment processing fees, bank expenses, and about $10,000 on advertisements.

A donation page for the Black Lives Matter PAC claims donations received will “help us elect progressive community leaders, activists and working-class candidates fighting for Black liberation.” The claims of supporting leftist candidates doesn’t align with the story revealed in 2023 filings by the PAC.

FEC records showed that the PAC spent zero dollars to support or oppose candidates and zero dollars on transfers to candidates or other committees in 2023. After most of its expenses went to the treasurer’s consulting firm, the PAC had just $3,575 cash on hand at the end of the year.

“The fact that BLM PAC funneled almost $100,000 back to their leader, all while spending nothing to support or oppose candidates, shows they are nothing more than a scam PAC,” Americans for Public Trust Executive Director Caitlin Sutherland said.

Sutherland said this is an example of “self-enrichment” from an organization facing many complaints about their “murky finances.” These patterns with expenses, while legal, “raise serious ethical concerns,” according to Craig Holman, a government affairs lobbyist at the nonpartisan consumer advocacy organization Public Citizen.

“[The] self-enrichment of having campaigns pay for services from businesses owned by the candidate or even campaign staff is an unnecessary loophole in the campaign finance law,” Holman said.

This isn’t the only jar Bowers has his hands in with BLM. Bowers Consulting Firm received more than $2 million from Black Lives Matter Global Network Foundation (BLMGNF), the 501(c)(3) nonprofit associated with Black Lives Matter PAC, according to tax documents. This was the same time frame where Bowers was listed as the principal officer of the nonprofit.

As president, Joe Biden has the supreme power to pardon criminals at will, and he has wielded that power for a large number of convicted Americans.

But it turns out that Biden has quite another connection to the presidential pardon, one dating back to the Civil War.

According to The Washington Post, this sordid bit of Biden family history lay hidden for 160 years among hundreds of court-martial cases in the National Archives until it was recently uncovered by researchers.

Government records show that Robinette was hired as a veterinary surgeon in 1862 or ’63. He was assigned to the Army of the Potomac’s reserve artillery and given the task of keeping its horses and mules in a state of readiness for war.

On March 21, 1864, Robinette got entangled in a fight with another civilian employee by the name of John J. Alexander.

It appears that Biden’s ancestor had been jawing about Alexander to a female cook and Alexander confronted Robinette about the gossip. The confrontation escalated into a physical altercation and an allegedly intoxicated Robinette pulled out a pocketknife.

The president’s great-great-grandfather proclaimed at his trial that he only acted in self-defense.

A transcript of the trial shows that he insisted “I had no malice towards Mr. Alexander before or since. He grabbed me and possibly might have injured me seriously had I not resorted to the means that I did.”

Regardless, Robinette was found guilty on all the counts but attempted murder and sentenced to two years of hard labor.

He then spent nearly three months in red-tape limbo. By July, as the Civil War raged on, he was sent to Fort Jefferson in the Dry Tortugas islands near Key West, Florida.

The officers’ letter first went to Sen. Waitman T. Willey from the new state of West Virginia. Willey endorsed the request and sent it along to the White House to the attention of President Abraham Lincoln.

After reviewing the records of the case, Lincoln decided in favor of Robinette, pardoning him on Sept. 1, 1864.

Once released, Robinette went home to Maryland and took up farming. He died at the age of 84 in 1903.

When Robinette’s obituary was published, it made no mention of his fracas with Mr. Alexander, his court-martial and conviction, nor his subsequent pardon by Honest Abe.

Perhaps he would be relieved to know that his name will go down in history for a much more auspicious reason thanks to his great-great-grandson and the country’s 46th president, Joseph Robinette Biden.
