‘This Is just egregious’: Megyn Kelly slams Biden’s last-minute pardons, but those pardoned can still face prosecution

SiriusXM’s Megyn Kelly called out former President Joe Biden’s last-minute pardons Monday on her show, outlining how those pardoned could still face prosecution at the state level.

On Monday, Biden issued a series of pardons throughout the day, with some announced just minutes before President Donald Trump was sworn into office. On “The Megyn Kelly Show,” Kelly discussed who the pardons extended to, highlighting how Dr. Anthony Fauci’s pardon dated back to 2014.

“Let’s go to the pardons because this is just egregious. Everybody under the sun, I mean, the J6 committee members, his entire family, right? Mark Milley and Dr. Fauci. By the way, the pardons go back, especially Fauci, go back to 2014,” Kelly said. “It starts in 2014 forward. What the hell was he doing in 2014? It’s because he funded gain of function research. It’s because he was behind the problem that caused the damn pandemic.”

“But there’s a question about whether it’s valid if they don’t accept.  I mean, there’s a legal debate on whether you must say I accept. I think most lawyers say, yeah, you have to say I accept it in order for it to be valid for you,” Kelly added. “So the Fauci one is the one that has me most ticked off. Because I really do think Fauci lied repeatedly to Congress. Rand Paul certainly thinks that, and I think was preparing to go after him.”

In his statement regarding the pardons for individuals like Fauci, former Chairman of the Joint Chiefs of Staff Mark Milley, and nine members of the Jan. 6 Select Committee, Biden said that they did not deserve to be “targets of unjustified and politically motivated prosecutions.”

Kelly went on to say that despite never being able to “find the smoking gun evidence” that Fauci was “was behind the COVID virus.” She said he worked on funded gain of function research. Kelly said it would be “wonderful” to get more information on Fauci’s involvement under the Trump administration. A guest jumped in to add that none of those being pardoned can plead the Fifth under oath.

“So that’s the silver lining. They all have to testify fully. They cannot plead the Fifth. By the way, it doesn’t stop any investigations whatsoever or civil lawsuits. You know what else it doesn’t stop? Or state lawsuits. State prosecutions,” Kelly said. “You can be prosecuted by the state, a federal pardon does not — that was Trump’s problem, remember?”

“We were saying like he could pardon himself, but only for the federal crimes, not for those state prosecutions in New York or in Georgia. Well, guess what, Dr. Fauci and J6 committee members and General Milley, you’re all in the same position,” Kelly added.

In May 2024, the House Oversight Committee released a report revealing that David Morens, a former advisor to Fauci, had suggested Fauci use a private email address to conduct government business, according to emails obtained by the committee. Additionally, Fauci testified before the House Subcommittee on the Coronavirus Pandemic in January 2024, where he was grilled by Republicans over his leadership during the COVID-19 pandemic.

During his testimony, Fauci was questioned about an audio recording from 2020 in which he discussed pushing vaccinations on Americans to the point where they would “lose their ideological bullshit.” In response, Fauci clarified that he was not referring to those who objected to the COVID-19 vaccine, but Republican Rep. Rich McCormick of Georgia called out the statement.

The FBI Agents Association (FBIAA) released a statement ripping former President Joe Biden for his last-minute move to commute the sentence of Leonard Peltier, a Native American who murdered two FBI agents decades ago.

The FBIAA — which represents more than 14,000 active and former FBI agents — characterized Biden’s decision to allow Peltier to serve out the rest of his sentence in home confinement as a stab in the back to the bureau and its employees. Peltier was convicted in 1977 for the 1975 murders of FBI Agents Jack Coler and Ronald Williams at the Pine Ridge Indian Reservation in South Dakota. He sought to get out of prison repeatedly before Biden, on the final day of his presidency, commuted his sentence.

“The FBI Agents Association (FBIAA) is outraged by then-President Biden’s decision to commute the sentence of Leonard Peltier, a convicted cop killer responsible for the brutal murders of FBI Special Agents Jack Coler and Ronald Williams. This last-second, disgraceful act by then-President Biden, which does not change Peltier’s guilt but does release him from prison, is cowardly and lacks accountability. It is a cruel betrayal to the families and colleagues of these fallen Agents and is a slap in the face of law enforcement,” the FBIAA said in its statement. “Agents Coler and Williams gave their lives in service to this nation, and their families continue to bear the heavy burden of that sacrifice. The loss of these heroes is felt as deeply today within the FBI family as it was in 1975. Leonard Peltier has never expressed remorse for his actions. Special Agents Coler and Williams were stolen from their families, robbed of the chance to share precious time and milestones with their loved ones. Leonard Peltier should not have been granted a mercy he so cruelly denied to the Coler and Williams families.”

“The profound sacrifice made by Agents Coler and Williams should be honored, not diminished. FBIAA remains steadfast in our commitment to preserving their legacies, and we look forward to working with new leadership in Washington to protect the public, honor our heroes, and leave cop killers where they belong — in prison,” the statement concludes.

Peltier executed the two agents at close range after getting into a shootout with them. He fled the scene before he was captured, tried, convicted, and imprisoned. Peltier later managed to escape prison before eventually being apprehended again.

In his statement announcing the commutation for Peltier, Biden pointed to Peltier’s advanced age, long tenure in prison to date, and deteriorating health as reasons for the commutation. During his incarceration, Peltier evolved into something of a cause célèbre for some activists who believed he was treated unfairly by the justice system or served time as a political prisoner.

Outgoing FBI Director Chris Wray, in a June 2024 letter to the then-acting chair of the U.S. Parole Commission Patricia K. Cushwa, said Peltier does not deserve parole. Wray also said that Peltier’s convictions and status had been reviewed.

“I write on behalf of the entire FBI family to express our adamant opposition to Leonard Peltier’s latest application for parole. Peltier is a remorseless killer who brutally murdered two of our own before embarking on a violent flight from justice,” Wray wrote in the letter to Cushwa. “His crimes also include a post-conviction escape from federal custody, during which he and his crew fired shots at prison employees. Throughout the years, Peltier has never accepted responsibility or shown remorse. He is wholly unfit for parole. To release Peltier now would significantly ‘depreciate the seriousness of his offense’ and ‘promote disrespect for the law.’”

‘Going to be a game-changer’: Homan breaks down key details on Trump’s upcoming executive orders to tighten borders

Tom Homan appeared Monday on Fox Business to discuss President Donald Trump’s executive actions aimed at tightening border security.

During an appearance on “The Evening Edit,” Homan shared some of the key details of Trump’s plan to tighten the border. Homan also said he was disappointed after the media failed to report a disturbing rise in human trafficking. He said there has been a 600% increase in the exploitation of women and children, along with a staggering 3,500% increase in the number of individuals on the terrorist watchlist attempting to enter the United States.

“He’s going to end catch and release. He’s going to put a stop to the CBP One app that’s been abused by people claiming fraudulent claims to asylum,” Homan said when asked to hint at Trump’s executive orders.

Homan said Trump intends to classify Mexican drug cartels as terrorist organizations, adding they play a significant role in the narcotics crisis and the deaths of countless Americans.

“The drug cartels of Mexico killed more Americans than every terrorist organization that were combined,” Homan said. “So these are a few things he’s going to sign and hats off. It’s going to be a game-changer on this administration. We’re going to secure the border at the highest level ever.”

Homan provided an overview of what he said are the border challenges and threats toward the country.

“The death of aliens across the border is at a historic high, over 4,000 under this administration. We got over a quarter million Americans dead from fentanyl coming across that open border. We got a 600% increase in sex trafficking on women and children. We got a record number of people on the terrorist watchlist. There’s a 3,500% increase in the terrorist watchlist,” Homan said.

Homan then recalled what he said was the effectiveness of border policies under Trump’s first administration.

“When President Trump, it was going to be graced on 90%. When 90% less people are coming, how many women weren’t being sexually assaulted? How many women and children weren’t trafficking? How many Americans didn’t die because of border security? They didn’t die of fentanyl. Secure borders save lives,” Homan said.

Addressing the media’s role, Homan expressed dissatisfaction with the coverage of border security issues.

“Absolutely not. This network does,” Homan said when asked if he feels like the American media is covering the border issues. “Fox does, but most of the media does not. They’ve been covering the border crisis. Look, not once have they spoken up about this out-of-control border, but they’ll talk about the fentanyl deaths, but they won’t talk about what’s causing that. Fentanyl deaths are out of control. This has been a hidden story for four years.”

During his inaugural speech in the Capitol Rotunda on Monday, Trump proclaimed a new “golden age” for America, pledging to dismantle the policies of his predecessor, Joe Biden. As he took the oath of office to become the 47th president, Trump said he would elevate the U.S. to unparalleled heights and ensure it becomes the envy of nations worldwide.

Trump said he will issue several executive orders, including ending catch and release, reinstating the Remain in Mexico policy, and declaring a national emergency at the U.S.-Mexico border.

J6 Committee members who insisted Biden shouldn’t hand out pardons end up accepting clemency after all

The nine former members of the January 6 Select Committee appeared to accept preemptive pardons issued by former President Biden during the last hours of his administration Monday despite several members previously urging the former president not to make them immune from prosecution related to their work on the select committee.

Biden granted members of the since-disbanded committee, including former Republican Reps. Liz Cheney of Wyoming and Adam Kinzinger of Illinois, and their staff broad immunity for their work investigating the events of Jan. 6, 2020, claiming the nine former committee members face “ongoing threats and intimidation for faithfully discharging their duties.” The members, on behalf of Cheney and former select committee chair, Democratic Mississippi Rep. Bennie Thompson, released a statement obtained by the Daily Caller News Foundation Monday appearing to accept blanket pardons while maintaining that accepting pardons is not an admission of guilt.

“On behalf of the Members of the Select Committee on the January 6th Attack on the United States Capitol, we express our gratitude to President Biden for recognizing that we and our families have been continuously targeted not only with harassment, lies, and threats of criminal violence but also with specific threats of criminal prosecution and imprisonment by members of the incoming administration, simply for doing our jobs and upholding our oaths of office,” the nine former members of the January 6 Select Committee wrote.”We have been pardoned today not for breaking the law but for upholding it.”

Several lawmakers who served on the select committee, including Kinzinger and California Democratic Sen. Adam Schiff, previously urged Biden to refrain from granting preemptive pardons, citing concerns that accepting a pardon would be perceived as an admission of guilt and would set a bad precedent.

“The second you take a pardon it looks like you’re guilty of something,” Kinzinger, a CNN political contributor, said on the network on Jan. 6. “I’m guilty of nothing besides bringing the truth to the American people and in the process, embarrassing Donald Trump.”

“Those of us on the committee are very proud of the work we did. We were doing vital, quintessential oversight of a violent attack on the capitol,” Schiff told ABC News’ George Stephanopoulos in December. “The precedent of giving blanket pardons — preemptive blanket pardons — on the way out of an administration is a precedent we don’t want to set.”

Only one former member, Democratic Mississippi Rep. Bennie Thompson, who led the select committee, said that he would accept a preemptive pardon prior to Biden granting members of the committee broad immunity from potential prosecution.

Republicans sharply criticized Biden’s unprecedented use of the presidential pardon power during the last hours of his administration. Republican Texas Rep. Chip Roy called for those who received broad immunity from potential prosecution, including the former members of the January 6 select committee, to be hauled before Congress.

“Implication is that they needed the pardons … So, let’s call them all before Congress and demand the truth,” Roy wrote on X on Monday. “If they refuse or lie – let’s test the constitutional ‘reach’ of these pardons with regard to their future actions.”

“It is disgraceful,” President Trump told NBC’s Kristen Welker Monday following Biden’s announcement. “Many are guilty of MAJOR Crimes!”

The select committee members also defended Biden’s issuance of pardons, citing “extraordinary circumstances” of allegedly facing prosecution by the incoming Trump administration despite maintaining their innocence.

“These are indeed ‘extraordinary circumstances’ when public servants are pardoned to prevent false prosecution by the government for having worked faithfully as Members of Congress to expose the facts of a months-long criminal effort to override the will of the voters after the 2020 elections, including by inciting a violent insurrection to thwart the peaceful transfer of power,” the members, on behalf of Cheney and Thompson, wrote. “Such a prosecution would be ordered and conducted by persons who led this unprecedented attack on our constitutional system.”

“We are not deterred, we have never been deterred, and we will never be deterred by threats of criminal violence or criminal prosecution, and we are encouraged greatly for the future of the rule of law by the existence of the Constitution’s sweeping Speech and Debate Clause as well as this general pardon by President Biden of our Committee and its excellent staff,” the committee members added.

Biden also issued blanket preemptive pardons to Dr. Anthony Fauci, former Chair of the Joint Chiefs of Staff Mark Milley, and five members of his family, including his brother James Biden, during the final hours of his administration.
