ACLU Lied to Get Illegal Immigrant an Abortion Before Supreme Court Could Rule

NATIONAL   MICAIAH BILGER   NOV 3, 2017   |   3:00PM    WASHINGTON, DC
The ACLU deceived the government in a highly publicized abortion case involving an illegal immigrant teen and her unborn baby, the Trump administration said Friday.
“Jane Doe,” the undocumented teenager at the center of the court battle, aborted her 16-week unborn baby on Oct. 25, barely a day after a federal appeals court forced Trump administration officials to help facilitate the abortion.
This week, Trump administration said the ACLU, which represented the teen, lied to its lawyers about when the teen’s abortion would take place, the AP reports.
“After informing Justice Department attorneys that the procedure would occur on October 26th, Jane Doe’s attorneys scheduled the abortion for the early morning hours of October 25th, thereby thwarting Supreme Court review,” Department of Justice spokesman Devin O’Malley said in a statement Friday.
Some questioned why the Trump administration did not appeal the Oct. 24 court ruling to the U.S. Supreme Court, but this new development explains why.
Here’s more from the AP:
The Department of Justice said Friday that the teen’s abortion was moved up without its lawyers’ knowledge, which meant administration lawyers didn’t appeal to the case to the Supreme Court before the procedure took place. The administration is now asking the Supreme Court to vacate a lower court ruling in favor of the teen, who entered the country illegally and is being held in a federal facility for unaccompanied minors in Texas.
The 17-year-old had an abortion on Oct. 25 after the full U.S. Court of Appeals for the District of Columbia Circuit ruled in her favor. The Department of Justice says its attorneys were told that the procedure would occur Oct. 26. The teen’s name and country of origin have been withheld because she’s a minor, and she is referred to in court paperwork as Jane Doe.
In the petition to the Supreme Court, the department said the ACLU violated its duty to the court and the Bar, and disciplinary actions may be warranted.
However, an ACLU spokesman said the claims are “baseless,” and shifted the blame onto the Trump administration.
“This administration has gone to astounding lengths to block this young woman from getting an abortion,” ACLU Legal Director David Cole said in a statement. “Now, because they were unable to stop her, they are raising baseless questions about our conduct. Our lawyers acted in the best interest of our client and in full compliance with the court orders and federal and Texas law. That government lawyers failed to seek judicial review quickly enough is their fault, not ours.”
According to the National Law Journal, the new accusations are connected to the 24-hour waiting period required between informed consent counseling and an abortion in Texas.
The report explains:
Doe had the counseling session earlier [in October], after a district court ordered the government to allow her to do so. …
DOJ wrote in the writ that while the ACLU lawyers argue they do not have any legal obligation to keep the government informed of the timing of Doe’s procedure, the ACLU repeatedly said in court and to the government that Doe would need a new counseling appointment before getting the abortion.
“Given the dealings between the parties, respondent’s counsel at least arguably had an obligation to notify the government of this incredibly significant development,” the writ said.
The 17-year-old “Jane Doe” came to the country illegally and was staying at a taxpayer-funded shelter in Texas when she requested an abortion. The shelter did not assist her, citing a new government policy that they offer life-affirming support to women and girls who are pregnant, according to Slate.
According to the report, the shelter took “Jane Doe” to a pro-life pregnancy resource center instead. The ACLU said the teen did not change her mind after receiving counseling, and scheduled an abortion; however, the shelter where she is staying refused to transport her to the appointment.
The ACLU sued on behalf of the teen, and after a series of appeals by the U.S. government and the ACLU, the pro-abortion legal group won in federal appeals court. The teen aborted her unborn baby the next day.
Planned Parenthood, NARAL and other abortion activists celebrated the news of the unborn baby’s abortion death.
Earlier this year under President Donald Trump’s administration, the Office of Refugee Resettlement issued a new policy requiring that taxpayer-funded shelters for immigrants and refugees offer life-affirming support to women and girls who are pregnant.
Office Director Scott Lloyd, a Trump nominee, said the shelters may not take “any action that facilitates” an abortion for unaccompanied minors without his direct approval.
Lloyd said that “grantees should not be supporting abortion services … only pregnancy services and life-affirming options counseling.”

Trump Admin Will Make Sex Ed Programs “Follow the Science” Instead of Blindly Funding Planned Parenthood

NATIONAL   STEVEN ERTELT   NOV 3, 2017   |   5:23PM    WASHINGTON, DC
The Trump Administration announced today that it will require sex ed programs to rely on science rather than blindly funding the Planned Parenthood abortion business as the Obama Administration did.
During the administration of Barack Obama, the Planned Parenthood abortion company received millions of dollars for its sexual education programs. However additional research shows those programs were not effective and the Trump Administration wants to put taxpayer funding behind programs that “follow the science to improve youth health and well-being” as opposed to merely funding the nation’s biggest abortion business.
The Department of Health and Human Services is beginning a new research effort regarding teen pregnancy prevention and sexual risk avoidance focused on, “testing new ideas and models” so that sex education programs, “follow the science to improve youth health and well-being.”
HHS officials point to statistics showing that 73% of the programs under the Teen Pregnancy Prevention (TPP), started under the Obama Administration, have been found to either have a negative impact or none whatsoever. The Trump administration requested that TPP be eliminated in the current budget. A Senior HHS official tells me that a new approach is needed.  “The results of their experiment are pretty clear. We think that young people deserve something better and that’s what we’re focused on giving them…this is a scientific endeavor. It’s really research based but we already have learned from the science, and the previous administration tried an approach that didn’t work.” While the Trump administration doesn’t want to fund TPP, they have continued to ask for money in the budget for,  “sexual risk avoidance education,” otherwise known as abstinence-based programs. “The administration has shown what the priorities are,” according to an HHS Senior official.
HHS will partner with the Mathematica Policy Research and RTI International.  The undertaking will cost ten million dollars over the next couple years.

Compared to 25 years ago, teen pregnancy rates are down significantly. But STD rates of young people 15-24 are higher than ever before.  An HHS official says, “We need to get to the bottom of both the positive and the negative trends.” The Obama administration will note that the drop in the teen pregnancy rate is proof that the programs are working but HHS officials say less than one percent of young people are serviced by these programs so that’s a false conclusion. They say more research is needed.
Officials at HHS are relying on the importance of the, “Success Sequence” as part of their equation to help young people live healthier productive lives. They point to an American Enterprise Institute and the Institute for Family Studies showing that, “Millennials are much more likely to flourish financially if they follow the ‘success sequence’—getting at least a high school degree, working full-time, and marrying before having any children, in that order.” An HHS official says avoiding sex before marriage helps even more. “Obviously if you’re factoring out having teen sex, that’s going to contribute to that.”

President Donald Trump Proclaims November 2017 as National Adoption Month

NATIONAL   WHITE HOUSE   NOV 3, 2017   |   6:21PM    WASHINGTON, DC
Every year, generous and loving families adopt thousands of children and provide them with the affection, attention, and opportunity they deserve. Adoption is a true blessing that greatly enriches the lives of parents and children alike. During National Adoption Month, we celebrate the thousands of families who have expanded through adoption, and we acknowledge the strength and resiliency of the children who are still waiting to find their forever home.
My Administration recognizes the profound importance of adoption for the American family. Adoption is a life-changing and life-affirming act that signals that no child in America — born or unborn — is unwanted or unloved. Adoptive parents are a selfless and loving part of God’s plan for their future children. As a Nation, we extend sincere appreciation and gratitude to those families who have welcomed a young person into their hearts and homes, sharing the precious gift of family and a lifetime of support.
We must continue to remove barriers to adoption whenever we can, so that the love and care of prospective adoptive parents can be directed to children waiting for their permanent homes. This year’s National Adoption Month, we focus on our commitment to helping older youth experience the transformative value of permanency and love. A child is never too old for adoption. A supportive family can provide the critical direction that older children need as they enter adulthood, helping them attain educational and employment goals, and, in certain cases, avoid homelessness or incarceration. We never outgrow the need for family, and older youth who are adopted are more likely to finish high school and feel emotionally secure than those who age out of foster care without a permanent family.
This month, let us celebrate the gift of adoption — an act of love that provides deserving young people with the foundation they need to achieve their potential and pursue the American Dream.
NOW, THEREFORE, I, DONALD J. TRUMP, President of the United States of America, by virtue of the authority vested in me by the Constitution and the laws of the United States, do hereby proclaim November 2017 as National Adoption Month. I encourage all Americans to observe this month by helping children in need of a permanent home secure a more promising future with a forever family, so they may enter adulthood with the love we all deserve.
IN WITNESS WHEREOF, I have hereunto set my hand this thirty-first day of October, in the year of our Lord two thousand seventeen, and of the Independence of the United States of America the two hundred and forty-second.
DONALD J. TRUMP
