Key Jewish leaders see this as an opportunity to reinforce support for Israel and to strengthen the fight against rising anti-Semitism in the U.S. and globally.
The Conference of Presidents of Major American Jewish Organizations, a coalition representing many prominent Jewish groups, extended their congratulations to Trump and Vice President-elect J.D. Vance. Leaders Harriet Schleifer and William Daroff voiced optimism that the incoming administration will continue its previous efforts to strengthen the U.S.-Israel relationship. They expressed hopes for building on Trump's accomplishments, particularly the Abraham Accords, which opened the door for historic peace deals between Israel and several Arab nations.
The Conference emphasized the urgency for the incoming administration to address key challenges, from countering Iran’s nuclear ambitions to supporting Israel's efforts to defend itself against terror threats like Hamas and Hezbollah. Schleifer and Daroff acknowledged that the administration would have little time to spare with pressing challenges both at home and abroad. "We stand ready to provide our help, counsel, and prayers," they said, underscoring their commitment to work alongside the new administration.
The Jewish Federations of North America (JFNA) also congratulated the president-elect. They noted their ongoing commitment to “flourishing” Jewish communities and highlighted the importance of continuing to secure strong support for Israel. In response to the recent divisive election, JFNA announced plans to host a “Stand Together” event in Washington, D.C., to foster unity and reaffirm the Jewish community’s priorities for the year ahead.
Similarly, the American Jewish Committee (AJC), represented by CEO Ted Deutch, shared their optimism about collaborating with the new administration on both domestic and international issues impacting Jewish advocacy. Deutch praised the Trump administration's previous strides, including its recognition of Jerusalem as Israel’s capital and steps taken to curb anti-Semitism on college campuses. The URJ pledged to back initiatives protecting vulnerable groups and promoting the well-being of both Israelis and Palestinians. The Orthodox Union (OU), another prominent Jewish organization, conveyed congratulations to the president-elect and his administration. The rule for how a special counsel can be named was put in place during the Watergate era, and that rule has more or less served as the standard for the last five decades.
Ray contends that Watergate was a special case, therefore, that should not be the rule, only the exception.
In his brief, he wrote, “From the 1850s through the 1950s, during six presidential administrations, Attorneys General retained outside lawyers as Special Counsels either: to assist a U.S. Attorney with prosecutions, or to assist the Attorney General with an investigation.
“And the Watergate Special Prosecutor is a thin reed to stand on. United States v. Nixon expressly and repeatedly recognized that the Watergate Special Prosecutor had ‘unique authority and tenure.’
“Further, in 1973, the Acting Attorney General, with the acquiescence of the President, granted the Special Prosecutor unsurpassed insulation against removal, thereby establishing Watergate as a unique case.”
This rule has never been challenged until now, but I find it hard to believe that the Supreme Court’s majority would make a ruling that would, in effect, nullify five decades of special counsel findings.
In this day and age, however, it would not be completely shocking.
Having said that, I still believe this is a bit of a stretch and that, ultimately, this line of attack to have Smith removed will fail.
On the flip side, it drags out the process, keeping this case out of the courtroom, likely, until after inauguration day, which means it is unlikely to ever see the inside of a courtroom anytime soon.
