Even before it leaked that Justice Stephen Breyer would be stepping down as associate justice of the U.S. Supreme Court, Joe Biden pledged to ramrod a Black woman onto the nation's high court.

President Joe Biden: "Choosing someone to sit on the Supreme Court, I believe, is one the most serious constitutional responsibilities a president has."
Joe Biden is scouring the nation for a Black woman to take the place of Supreme Court Justice Stephen Breyer, whose retirement was announced late last month.
Following the news, sham-Catholic Biden quickly renewed his promise to find the most qualified liberal Black woman for the job.
Biden: "Our process is going to be rigorous. I've made no decision except one: The person I will nominate will be someone with extraordinary qualifications, character, experience and integrity — and that person will be the first Black woman ever nominated to the United States Supreme Court."
Joe Biden's woke pledge represents a racial-sexual quota — transcending even regular leftist affirmative action. Affirmative action is the practice of favoring candidates based on skin color and sex, rather than on talent and credentials. Quotas make these characteristics into necessary qualifications.
But according to the Due Process Clause of the Fifth Amendment, the federal government must treat all classes of people alike. Indeed, in Bolling v. Sharpe, the Supreme Court held that race-based discrimination is "so unjustifiable as to be violative of due process."
In a 1978 case, Regents of the University of California v. Bakke, which struck down a medical school's racial quota, SCOTUS justice Lewis Powell inveighed: "Making racial distinctions is odious to a free people whose institutions are founded upon the doctrine of equality."
But now, the sitting president of the United States is flaunting racial and sexual discrimination right in the nation's face. Democrats are cheering Biden on as he combs through the thin ranks of Black female judges for an heiress to the Breyer seat.
The Left has long attempted to score political points by putting first representatives of minority classes into leadership positions.
In 2008, Barack Obama was lauded as the first Black president. Now, Kamala Harris is exalted as America's first Black female vice president. Biden's principal deputy press secretary is the first Black female lesbian working in the White House.
But what's lost on account of the Left's obsession with social justice optics is merit and the emphasis on a candidate's facility for a given job — to say nothing of the equal protection of the laws. While Biden may find a candidate to fit the liberal-Black-female category, the United States Constitution could stand in his way.
Biden could succeed in getting a liberal Black woman on the Supreme Court bench, unless a brave challenger takes the unelected president to court.
