Appeals court orders Christians to pay lesbians $135,000 for refusing to bake ‘wedding’ cake

PORTLAND, Oregon, January 3, 2018 (LifeSiteNews) – A U.S. court of appeal dealt religious freedom another legal blow last week as it upheld a penalty against Christian bakers Aaron and Melissa Klein for declining to create a "wedding" cake for two lesbians almost five years ago.
Lawyers for the Kleins said state Labor Commissioner Brad Avakian and the state Bureau of Labor and Industries violated the Kleins’ rights as artists to free speech, their rights to religious freedom and their rights as defendants to a due process.
Avakian had ordered the owners of now-closed Sweet Cakes by Melissa to pay emotional-distress damages of $135,000 to the lesbians.

The Oregon Court of Appeals sided with the state last week, the Washington Post reports, saying the Kleins failed to show the state targeted them for their religious beliefs.
The court said the Kleins’ argument that their cakes are an artistic expression is “entitled to be taken seriously,” but it’s not enough for the couple to assert their cakes constitute art; they must show that others perceive their creations like a sculpture or painting.
“Although we accept that the Kleins imbue each wedding cake with their own aesthetic choices,” the judges said, “they have made no showing that other people will necessarily experience any wedding cake that the Kleins create predominantly as ‘expression’ rather than as food.”
First Liberty Institute, the legal group representing the Kleins, criticized the ruling.
“The Oregon Court of Appeals decided that Aaron and Melissa Klein are not entitled to the Constitution’s promises of religious liberty and free speech,” said First Liberty President Kelly Shackelford. “In a diverse and pluralistic society, people of good will should be able to peacefully coexist with different beliefs.”
The court also said that public statements from Avakian before deciding the case did not establish a lack of impartiality.
Avakian had told local media around the time of the 2015 fine, “The goal is to rehabilitate. For those who do violate the law, we want them to learn from that experience and have a good, successful business in Oregon.”
Avakian had also modified the proposed order from the administrative law judge he’d appointed to include a condition ordering the Kleins not to speak “publicly about not wanting to bake cakes for same-sex weddings based on their Christian beliefs.”
The Kleins declined in 2013 to create a cake for Rachel Bowman-Cryer and her same-sex partner based upon their religious convictions.
The lesbians subsequently filed a complaint with Oregon’s Bureau of Labor and Industries, alleging discrimination on the part of the suburban Portland bakers on the basis of sexual orientation—despite same-sex "marriage" not having become legal in Oregon until 2014.
The state determined that the Kleins had violated a 2007 Oregon law protecting the rights of gays, lesbians, bisexual and transgender people in employment, housing and public accommodations. The law provides an exemption for religious organizations, but does not allow private businesses to discriminate based on sexual orientation.
Even though the Kleins had served Bowman-Cryer and her partner in the past prior to their request for a gay "wedding" cake, Avakian sided with the lesbian couple, awarding the $135,000 in damages.
The alleged emotional trauma list in the complaint from Bowman-Cryer and her partner included “excessive sleep,” “high blood pressure,” “impaired digestion,” “loss of appetite,” “migraine headaches” and “weight gain.”
They also claimed the incident left them feeling “mentally raped.”
The Kleins and their five children had sent cakes decorated with hearts and the message, “We really do love you!” to LGBT activist groups after they were fined.
“Today’s ruling sends a strong signal that Oregon remains open to all,” Avakian said after the ruling was released.

Liberal law center ranks ‘#merrychristmas’ as top Twitter ‘hate’ speech on Christmas day

MONTGOMERY, Alabama, January 3, 2018 (LifeSiteNews) – The hashtag “#merrychristmas” topped the far-left Southern Poverty Law Center’s (SPLC) list of trending hashtags on Twitter that it considers to be promoting “hate.”
On December 24, the #merrychristmas hashtag had the # 2 ranking on SPLC’s “Hate Tracker” list. Then on Christmas Day, #merrychristmas was ranked # 1, and on December 26, it ranked # 3
Along with “Merry Christmas” the SPLC Hate Tracker website recently listed #christmas, #merrychristmaseve and #jesus in its top trends used by what it terms “far-right Twitter users.”
According to SPLC, the Twitter accounts they monitor for “hate” speech “represent a range of extremists – from the conspiratorial fringes of mainstream conservatism to outright white supremacists – who regularly use Twitter as a tool for media subversion, ideological indoctrination and propaganda dissemination.”
“The Hate Tracker detects trends in a community of far-right Twitter users identified and reviewed by analysts in the Southern Poverty Law Center’s Intelligence Project,” the group states.
Christian legal advocacy group Liberty Counsel (LC), said that after LC and other media sources challenged the SPLC on the Hate Tracker list, SPLC has since claimed the rankings are created with an automatic feed of popular tweets among those it claims are hate groups.
SPLC also subsequently said that the "Hate Tracker" webpage doesn’t actually track hate - it just tracks what is being tweeted by allegedly hateful people.
“The SPLC is willing to lump anyone who says “Merry Christmas” or “Jesus” in with the most violent and racist groups in America,” Liberty Counsel stated. “This is one more way that the SPLC is exposing its own radical, discredited, anti-Christian hate.”
“The SPLC cannot run from the clear intent of its "Hate Tracker" page,” LC continued. “The SPLC website plainly states that it is a "Hate Tracker."
SPLC also lumped the "Christmas"-related and "Jesus" hashtags with "#whitegenocide" and "#ineedwhitesupremacybecause" last week.
“The SPLC’s agenda willfully combines pro-family, Christian, and/or conservative groups and leaders with the KKK, white supremacists, and Neo-Nazis in the mind of the public to damage the reputations of good people who oppose violence,” LC stated.
Additionally, SPLC had changed its Hate Tracker page after LC and others reported on the page, LC said, and continues to manipulate the information it claims to provide.
For example, LC said that on SPLC’s December 27 Hate Tracker page, it claims that the 12th highest "trending hashtag" among all the supposed "hate groups" it claims to monitor is "#ineedwhitesupremacybecause."
LC said a Twitter fact-check showed inconsistencies, such as just two tweets across Twitter with the hashtag that day, and no Twitter accounts mentioned with that hashtag were shown on SPLC’s own page. Also, there were no images found, even though one of the two Twitter users posting with the hashtag included an image with their tweet.
“This indicates that SPLC’s claimed "algorithm" does not automatically pull all images,” said the LC release. “These inconsistencies raise serious questions about the SPLC and its misrepresentation of the groups they "monitor," the algorithms used, and the complete ineffectiveness of the organization to track what it claims.”
The SPLC - a left-leaning non-profit well funded to the tune of some $58-plus-million in annual revenue - has continuously worked for years to sully and silence conservative and Christian groups and individuals as haters and extremists.
The liberal “hate monitor” group sued a small Jewish counseling ministry over its reparative therapy practice. Funneling millions of dollars and a dozen lawyers into the legal argument that JONAH’s reparative therapy that served men with unwanted same-sex attraction was fraudulent, SPLC forced the ministry to shut down via the 2015 ruling.
SPLC’s designation of Family Research Council (FRC) as a “hate group” on its “Hate Map” led to the attempted mass murder in 2012 by Floyd Lee Corkins, a “gay rights” activist volunteer.
Corkins said he had identified and targeted FRC because of SPLC’s “Hate Map.”
This past summer an SPLC Facebook follower, James Hodgkinson, attempted to killCongressional Republicans as they practiced for a charity baseball game, critically wounding Representative Steve Scalise. A staffer and two members of the Capitol Police were wounded as well.
While it disavowed Hodgkinson’s act, SPLC had identified Scalise as a white supremacist.

Woman forgoes cervical exam after request for female nurse gets her stubbly transexual instead

LONDON, England, January 3, 2018 (LifeSiteNews) – A woman who had requested a female nurse to conduct her cervical exam (pap smear) was shocked when a male nurse appeared instead who claimed to be "transsexual."
The woman, who has not been named, described the nurse as having “an obviously male appearance, close-cropped hair, a male facial appearance and voice, [a] large number of tattoos and facial stubble.”
The patient told Sunday Times, “People who are not comfortable about this are presented as bigots and this is kind of how I was made to feel about it.”
She decided not to go through with her exam and later complained to the National Health Service.
The woman said it was “weird where somebody says to you: ‘My gender is not male’ and you think ‘Well what does that even mean? You are clearly a man.’"
The incident took place last September 17 at the North West London NHS Foundation. The NHS has apologized.
The story highlights the difficulties transgenderism poses for women who are uncomfortable having biological males in their personal spaces or performing gynecological examinations. This is particularly serious when it comes to cervical cancer prevention. The NHS in Scotland, for example, encourages adult women to have cervical exams once every two years.
Women’s improved position in society, which includes the opportunity to become or be treated by female medical professionals, seems to have had a setback as the interests of biological males who want to be considered "women" compete with the interests of real women.
The biological realities of womanhood are so central to female experience that it may be difficult for biological males to understand why most women feel a need to keep certain functions and treatments deeply private, or carried out only among fellow biological women.
There is a vulnerability to biological womanhood that society, including biological males who sincerely believe they are "women," must always respect.

Parents, your teens are being pressured to ‘sext.’ Even at Christian high schools.

January 3, 2018 (LifeSiteNews) – I travel a lot throughout North America speaking on the pervasiveness of the poisonous porn plague, and when I speak to parents, they are stunned when I read off statistics that highlight just how prevalent sexting is in nearly every single high school. When I speak to students, on the other hand, there is no shock. They look at each other knowingly. Some flush and duck their heads. Others squirm uncomfortably, their smartphones burning a hole in their pocket.
In fact, at a recent high school I was speaking at, I explained to the girls why guys asking them for nude photos or selfies should get immediately dumped, and there were several boys staring at me with open malevolence, furious at what I was saying. The girls, on the other hand, were often nodding emphatically—and of the written questions I collected after the presentation, nearly a dozen were about how to say no to such requests, what to do after sending these pictures, and how to help friends that were terrified that these pictures were being sent on to others.
The truth is that most of these pictures are being sent on, and they are being routinely shared. Boys in high schools right across North America actually have online pages they call “slut pages” where they aggregate photos of the teen girls they go to school with. Teenage relationships, of course, end with great frequency and often much emotional pain—and many teens respond to the pain of breakup by sending intimate photos they have received on to all of their friends. North American high schools today are beginning to resemble a sexual Hunger Games.
And now, even the New York Times has noticed this trend, and rang in the New Year by publishing an extensive analysis of the situation:
Teenagers are drafted into a sexual culture that rests on a harmful premise: On the heterosexual field, boys typically play offense and girls play defense. This problematic framework underlies the findings of a new study that documents, in alarming detail, girls’ reports of the common coercive practices boys use to solicit nude digital photographs. An analysis of nearly 500 accounts from 12- to 18-year-old girls about their negative experiences with sexting found that over two-thirds had been asked for explicit images.
The majority described facing intense pressure that often began with promises of affection and discretion in exchange for “nudes,” before accelerating to “persistent requests, anger displays, harassment and threats.” The study drew from comments posted between 2010 and 2016 on A Thin Line, MTV’s campaign against sexting, cyber bullying and digital dating abuse. As one research participant explained about being pressured by her boyfriend, with the shorthand and spelling errors of a texting teenager:
my bf preaused me for hours to send him pictures of me naked. Now he threarens to send them out if i dont send hin more really nasty pics. The stuff i have to do is unbelievable. im 14.
I’ve heard that exact same story from teen girls, over and over again. One teen told me that the pressure to send pictures was “relentless,” and that the guys simply didn’t stop asking until the girls caved and sent one. If they didn’t send one, the guys would often shift their attention to other girls, creating the impression that sending nude selfies was simply the price one had to pay to gain the attention of the boys. And of course, once the photos are sent, as that awful text above reveals, the power dynamic shifts to the boys and girls often feel trapped. One girl told me that everyone could tell when a photo had been sent around to everyone—when the victim walked into the cafeteria at lunch the next day, all eyes would be on her. The Times cited another text from a girl that revealed the pressure prevalent in high schools:
…they want me to send naked pics of me and I don’t want to send them….but like idk wat to do cuz they said if I don’t send them tht their goinq to spreads roumors and help me out plzzz :((
The advice of the New York Times is simple: “Teenagers, stop asking for nude photos.” It’s about time that the inherent harm and danger of this practice received a more honest appraisal from the mainstream media, especially considering the fact that many girls have already killed themselves after humiliating or intimate photos were sent around to their peers, and there are boys in their teens who are already registered sex offenders for life as the result of such behavior. This practice, in short, is destroying young lives before they even have a chance to mature and understand the types of forces they are playing with. Not even millionaire celebrities like Jennifer Lawrence, after all, could keep her intimate photos from being malevolently leaked onto the Internet.
Parents, you need to understand the sexual culture your sons and daughters are facing in high school. I realize that this is hard to believe, but sending nude photos from teen to teen is prevalent—in Christian high schools, as well. I would go so far as to say that it is common in Christian schools, and that one of the reasons this practice has spread so far and so fast is that parents are not even aware that this is taking place—even though their children are making horrifyingly permanent decisions that will impact the rest of their lives.
