A mother is suing California, charging state laws allowed employees at a Los Angeles hospital to turn off her son’s life support and let him die, even though he had shown signs of life.
The non-profit Pacific Justice Institute has filed its opening brief with a federal appeals court on behalf of Jonee Fonseca and the Life Legal Defense Foundation.
The dispute centers on a diagnosis of PVS, persistent vegetative state, in which a patient is comatose but still shows signs of life. The hospital turned off life support for 2-year-old Israel Stinson because a death certificate had been issued.
The case follows by only months a ruling in a similar case in California that allowed a malpractice lawsuit against a hospital to move forward even though a death certificate had been issued for teenager Jahi McMath.
In the Stinson case, the brief filing with the 9th U.S. Circuit Court of Appeals concedes the boy is dead.
“No human power can call him back to life,” the filing states. “But his dignity can be reclaimed, his family’s fundamental rights to self-determination restored, and the statues that provided authority for the taking of his life rescinded.”
The complaint challenges the application of the state’s Uniform Determination of Death Act by Kaiser, arguing the boy “continued to show signs of life and responded to his mother’s voice and touch.”
He had suffered an asthma attack early in 2016 and doctors pronounced him dead. His mother kept him on life support, and when doctors sought to disconnect him, she moved him to Guatemala for treatment.
There, according to the complaint, he “remained biological alive with a chance of recovery.”
“In the late summer of 2016, Israel’s family was led to believe he could receive treatment at Children’s Hospital of Los Angeles and brought him back to the United States. But when the hospital learned that the state had issued a death certificate months earlier, they sought to terminate life support. The hospital would not permit an independent examination by an eminent doctor from UCLA who was prepared to assist the family,” Pacific Justice said.
The boy was moved to Kaiser, and then the hospital obtained permission to disconnect him from life support. Even as “an attorney frantically raced to the Second District Court of Appeals,” he was cut off from life support.
“As that attorney was handing a clerk his credit card to process payment for an appeal and request for stay, the hospital forcibly removed life support and the child expired.”
PJI then represented Israel’s mother in her challenge to the constitutionality of state laws that take away life-and-death decisions from parents.
A federal court in Sacramento dismissed the case, holding that the state cannot be held responsible for its determination-of-death laws, because doctors have “broad and legitimate discretion” to end patients’ life support, PJI said.
“What happened to our client was every parent’s worst nightmare. To see her son fighting for life while two different hospitals fought – and ultimately succeeded – in ending his life was an excruciating and unimaginable horror. This should never happen to another family, and that’s why we are challenging the state laws that facilitated this deprivation of life without due process. Doctors do not have broad discretion to end patients’ lives without their consent,” PJI said.
To be resolved, the appeal states, are questions over the deprivation of life and liberty in violation of due process, deprivation of parental rights, deprivation of life and  privacy violations.
“To the extent physicians are currently permitted to act as both judge and executioner, due process demands they be restrained,” the filing explains.
While the boy was in Guatemala, physicians ran two EEG tests and “found that Israel was neither biologically nor brain dead.” But when he was returned to the U.S., his condition deteriorated again, and physicians used those circumstances to obtain an order to let him die.
The complaint seeks a determination that the California law “falls below the constitutional minimum for safeguarding life, asking the court to “prevent the same tragedy from striking other families,” the filing states.
‘Intermittently responsive’
In the McMath case, an expert testified in court that the girl, for whom a death certificate had been issued, still was alive.
WND reported McMath suffered complications following a routine tonsillectomy in late 2013 and was declared brain dead.
During 2017, her family submitted court filings declaring she had been on life support in an undisclosed location the past few years, meaning she was alive.
The documents included testimony from Dr. Alan Shewman, professor emeritus of pediatrics and neurology at the David Geffen School of Medicine at UCLA, whose declaration with the Superior Court in Alameda County, California, provided the details.
“There is no question that in December 2013 at Oakland Children’s Hospital, Jahi McMath fulfilled the widely accepted pediatric guidelines for determining brain death (hereinafter referred to simply as the Guidelines), as well as the adult guidelines,” he wrote in the court statement, “both regarded as the accepted medical standards.
“There is equally no question in my mind that she no longer does, for the single reason that the first of the ‘three cardinal findings in brain death,’ – coma, absence of brainstem reflexes, and apnea – is not fulfilled. Rather, she is intermittently responsive, placing her in the category of ‘minimally conscious state.'”
He continued: “The change took place round the spring of 2014, when Jahi’s family members began to suspect that she sometimes seemed to respond to commands. When I first heard of this through the news media, I was as skeptical as everyone else, assuming that they were mistaking spinal reflexes or myoclonus (involuntary quick jerks) for voluntary movements.
“Because of my research interest in the phenomenon of chronic brain death, I contacted Jahi’s family through her attorney, Christopher Dolan,” said the doctor, who verified he has not and is not charging the family for any of his consultations.
“Realizing that no one was likely to believe them about Jahi’s intermittent responsiveness, the family began making video recordings of what they believed to be responses to simple commands. They gradually formed the impression that Jahi’s responsiveness tended to occur when her heart rate was above 80 beats per minute, and hardly ever when it was slower – suggesting the possibility of some sort of inner state differentiation, with responsiveness more likely during the more aroused state.”

FAQ :: How can the backslidden be restored to faith?

“Brethren, if anyone among you wanders from the truth, and someone turns him back, let him know that he who turns a sinner from the error of his way will save a soul from death and cover a multitude of sins” (James 5:19-20).
When a brother or sister in the Lord backslide it is the duty of other believers to help bring them back (Galatians 6.1). If they repent you will save them from being judged by the church (Matthew 18.15-17), and possibly by God, who sometimes takes backsliders home (John 15.2, 6; 1 Corinthians 5.5).
When anyone helps bring a prodigal brother back to faith the sins that the backslider committed must be kept quiet. It does no one any good to broadcast to the entire church and the world every sin the backslider committed. Only the one who brings him back and possibly the pastors should know what sins have been committed.
The backslider should be the one to tell the pastors what sins he committed if he feels a need to. If someone confides in you, the best thing to do is be as loving and be available as possible. Spend time together in prayer and reading the Bible. Encouragement and tender loving care are very much needed when a fallen brother or sister repents and sincerely wants to serve the Lord again.

FAQ :: How can I overcome temptation?

Jesus quoted Deuteronomy 8.3 to rebuke the devil when he tempted Him to turn stones into bread after fasting for 40 days. When tempted by the forces of darkness, we must quote Scripture as Jesus did. More important, we must remember that our only spiritual food is the Word of God. Increase your time spent reading and studying the Bible.
We are in a fierce spiritual war with the forces of darkness and we must be ready for battle every day. We do that by putting on the armor of God. Every day we must gird our loins with the Truth, put on the breastplate of righteousness, shod our feet with the gospel of peace, take up the shield of faith, put on the helmet of salvation and take up the sword of the Spirit (Ephesians 6.13-18).
Girding one’s loins with the Truth is: knowing Scripture. Shodding our feet with the gospel is learning how and sharing the gospel by quoting the basic salvation passages (Romans 3.23, Hebrews 9.27; Matthew 25.46; Romans 5.8; John 3.16; Romans 6.23; Ephesians 2.8-9; John 14.6; Acts 12.4; John 1.12).
Taking up the sword of the Spirit is: memorizing Scripture so you can quote it when tempted by the forces of darkness. And remember to pray without ceasing (1 Thessalonians 5.17).

FAQ :: If I sin, does that mean I was never saved?

The thing that causes new Christians to struggle the most is the conflict between their new identity and their old identity. They think that once they are saved, they will no longer battle the desires of the flesh and will live a perfect life. That is untrue; in fact, the battle can feel stronger because before becoming a Christian, there was no struggle.
The last thing the devil wants is for a person to accept Jesus Christ as his personal Savior. Once a person does that, the only thing the devil can do is dangle temptations and lies in his face. If Satan can cause a person to believe that he or she is failing and will never be good enough, then he has achieved his purpose: to keep a believer from living in the fullness of God’s grace.
The Apostle Paul struggled with this on a daily basis. In Romans, he describes his inner struggle perfectly. I can say it no better, so I will quote the entire passage.
Romans 7:15-20: “I do not understand what I do. For what I want to do I do not do, but what I hate I do. And if I do what I do not want to do, I agree that the law is good. As it is, it is no longer I myself who do it, but it is sin living in me. I know that nothing good lives in me, that is, in my sinful nature. For I have the desire to do what is good, but I cannot carry it out. For what I do is not the good I want to do; no, the evil I do not want to do–this I keep on doing. Now if I do what I do not want to do, it is no longer I who do it, but it is the sin living in me that does it.”
Paul is saying that even though he has accepted Christ and is actively serving Him, he still battles with his flesh. We are called as believers to trample on that flesh and die to it daily. However, we will fail at times and, as Paul says in the next chapter, “Therefore there is now no condemnation for those who are in Christ Jesus, because through Christ Jesus the law of the Spirit of life set me free from the law of sin and death.”
That is no excuse to sin! Romans 6:1-2: “What shall we say, then? Shall we go on sinning so that grace may increase? By no means! We died to sin; how can we live in it any longer?” Clearly, we will fail. But we are to grow from the experience, not live in it, constantly relying on God’s grace to forgive.

FAQ :: I am a good person, so I can count on going to Heaven, right?

By whose standards are you measuring your goodness?
Romans 3.23: “For all have sinned and fallen short of the glory of God.”
This verse very clearly says that all people are unworthy of God’s goodness. Being a good person can help us get through this life. It can attract some good friendships and cause people to trust us and lean on us in difficult times. However, it is not what God requires of us. If God held us to the standard He requires no one would ever make it into heaven. God has known since the beginning of time that Man is incapable of perfecting himself, so He has been trying to show us our need for a Savior through our own weakness. It is through Christ and Christ alone that we are made righteous.
1 John 1.9: “If we confess our sins, he is faithful and just to forgive us our sins and purify us from all unrighteousness.” The first step is recognizing that no one is good enough. Second, we need to repent of sinfulness, especially the sin of pride–believing that we have somehow done something to make us worthy to spend eternity in the presence of God. Only then can God cleanse our hearts. Isaiah 1:18b says, “Though your sins are like scarlet, they shall be white as snow.”
Heaven is a holy place requiring salvation in Christ before entrance is allowed. It is not an automatic right for just anyone. It is a gift given to God’s children—people who have come to a faith in Christ and who have made Him Savior and Lord of their lives.
Many denominations and cults believe that there are many roads to heaven. Scripture clearly teaches that only through Jesus Christ can anyone enter the kingdom of heaven:
[Jesus said,] “I am the way and the truth and the life. No one comes to the Father except through me” (John 14:6).

FAQ :: If God is choosing who is saved, doesn’t that cancel out our free will to choose and believe in Christ?

The Bible says that everyone has choice and all who believe in Jesus Christ will be saved (John 3:16; Romans 10:9-10). The Word of God never describes God rejecting anyone who believes in Him or turning away anyone who is truly seeking Him (Deuteronomy 4:29). God in His infinite wisdom has a way to integrate predestination with a person being called by God (John 6:44) and coming to faith unto salvation (Romans 1:16).
God predestines who will be saved, and we must choose Christ in order to be saved. Both facts are equally true.
“Oh, the depth of the riches both of the wisdom and knowledge of God! How unsearchable are His judgments and His ways past finding out!” (Romans 11:33)

FAQ :: Does baptism save me?

No more than swimming saves you.
Baptism is never presented in the Scriptures as saving anyone. When baptism is mentioned in the context of salvation, you will always find it paired with something else that would demonstrate belief. But don’t stop here. The rest may be of great importance to your position.
In Mark 16:15-16, Jesus said that those who believe and are baptized would be saved.
There is much controversy (unnecessarily, I believe) over the question of baptism’s place in salvation. I believe that my next comments may disagree with Todd’s beliefs, but they are presented with all respect to his understanding and love for him and his work. I find that I must teach what I understand to be the truth.
In addition to the reference in Mark, and the numerous instances of baptism with respect to salvation in the New Testament (1 Peter 3:21, etc.), I look back to the Old Testament, 2 Kings chapter 5.
In this instance, we find Namaan. He has leprosy. He is informed about a prophet in Israel who can help. After a roundabout route, including a visit to the king, he winds up at the house of Elisha, a prophet of God. Without coming out of the house, Elisha sends a messenger to instruct Namaan to wash himself in the Jordan River seven times and he would be clean. Namaan was furious and refused, citing rivers in the North that were better. His escorts asked him, “If the Prophet asked you to do something hard, would you do it? Why then do you refuse when he says wash and be clean?” Namaan gives in, washes seven times and is clean.
My reasoning is this: What if he had not washed? Would Namaan have been cleansed? The obvious answer is no, he would have died a leper.
Jesus himself said that those who believe and are baptized would be saved. A further New Testament study reveals what He means by this. Evidence of our belief is in our actions, not our words. This action results in the bearing of fruit as we are led by the Holy Spirit to act–not doing works to be saved, but because we are saved (see James). There are no works that can save us.
Thus a dilemma: Is baptism a work? I vote no. Using reasoning that baptism is a work could just as easily reason that faith or belief in Jesus is a work. You have to do it or there is no salvation. Baptism is a faithful response to an offer of eternal salvation and a declaration of that faith, just like Namaan. Was it the washing that cleansed him? No, it was his faithful response to an offer of cleansing.
Regardless of your belief in the role of baptism in salvation, Jesus himself commanded it. The apostles many times reiterated this command and practiced it. We can do no less. But do not view baptism as saving you. Only Jesus can do that and even so, only through our faith. I say respond.

FAQ :: I believe in God. Does that mean I am saved?

It depends on what you mean by “believe.” The Bible says that even the devil and his demons believe in Jesus Christ. Belief in His existence must be followed by belief in the saving power of His blood. Then, there must be faith that if you call on Him, He will hear your prayer and will forgive you of your sins. Finally, that belief and faith must be followed by the action of surrendering yourself to Him.
If you believe in Jesus Christ, but have not taken that final step to begin a personal relationship with Him, don’t wait a moment longer. Ask Jesus to forgive you of your sins, truly repent and surrender your will to His. At that moment, your belief will be turned into salvation and the Holy Spirit will come to live inside you. FAQ :: I am not emotional and did not cry when I became a Christian. Am I saved?

Think of the birth of a baby. Some fathers jump for joy at the sight of their newborn, some weep with pride, others pass out. Would anyone say that the only father who loves his new baby is the one who cried? Of course not. Every person has a different make-up with different ways of approaching a given situation. Some people are excitable; some are emotional; and some are clinical.
“For God so loved the world that he gave his one and only Son, that whoever believes in him shall not perish but have eternal life” (Jn. 3:16). It is clear that whoever believes in Him will have eternal life. There is no Scripture that says that a requirement for salvation is tears. If, in faith, you turned to the Lord in repentance of your sins, you are saved.
If you are concerned about your lack of emotional response, you can pray that the Lord will begin to chip away at whatever walls you have built around yourself that keep you from letting go, at times. He wants to heal you from the inside out. Once He breaks down the walls in your life you will feel free to express yourself more openly.

FAQ :: Can I just have fun while I am young and then get saved later?

“Later” is a risky gamble. Many things could happen throughout the day that would guarantee that you will have no “later.” Your eternal destiny is far too important to risk. The words that John the Baptist spoke are still true, “Repent, for the kingdom of heaven is near.” And you must be careful because the Bible warns, “A man who remains stiff-necked after many rebukes will suddenly be destroyed-without remedy” (Prov. 29:1).
Why do you think that being a Christian means that you don’t get to have fun? What is it about your life right now that is so important, so fun, that not only could you not live without it, but you would also risk your eternal life for it? Seriously examine your life and find the things that you would likely have to give up in order to follow Christ. I challenge you to take those issues to the Lord in prayer. Ask Him to help you to have the proper perspective on sin and to give you the strength you need to turn from sin and turn towards Him.

Democrats are vowing to undo parts of the GOP’s tax-code overhaul if they win back control of the House in November, hoping President Trump’s first major domestic achievement will be a liability for the Republicans in the midterm elections.
The effort is reminiscent of the Republicans’ long-drawn campaign to hammer away at the Affordable Care Act and turn President Obama’s signature health-care expansion into a down-ballot albatross for the Democrats — an effort that helped the Republicans retake the House with sweeping election victories in 2010.
“We should repeal it and I think we should offer an alternative tax plan, which is we’re going to provide the tax relief to the middle class and the working class,” said Rep. Ro Khanna(D-Calif.).
Democratic leaders are encouraging their troops to stage district-based tax-reform “teach-ins” designed to convince voters “what this tax scam means to families,” in the words of the direct appeal from House Minority Leader Nancy Pelosi (D-Calif.).
Republicans are ready to hammer Democrats for vowing to repeal much of the tax law, arguing their opponents would be foolish to run on a message of raising taxes.
“I would welcome Democrats running for election based on, ‘Let us slow down the American economy, raise taxes and make sure people’s paychecks are stagnant for another decade,’ ” House Ways and Means Committee Chairman Kevin Brady (R-Texas) told reporters earlier this week.
“That would be a terrible campaign theme for them to run on, but I welcome them to do it,” he said.
Republicans think the new law will ultimately be to their benefit, noting that polls show support growing. A Monmouth University poll found voters evenly split between approval and disapproval of the law, though it also found that more people expect to see their taxes go up than see their taxes go down.
Democrats are offering few details about what a replacement plan would look like, recognizing that legislation to roll back parts of the law won’t get far while Trump is in the White House. But painting in broad strokes, the lawmakers say they want to shift a bulk of the law’s benefits from the wealthy to the middle class.
“The polling on this bill is terrible for them,” said Rep. Jan Schakowsky (D-Ill.). “Americans don’t like it because they think they’re getting crumbs and people like Donald Trump are getting, literally, millions of dollars.”
The tax law Trump signed in December lowers the corporate tax rate from 35 percent to 21 percent. It also lowers rates across the board for individuals and creates a new deduction for income from noncorporate businesses.
No Democrats voted for the law, saying it’s a “scam” that helps the wealthy at the expense of working families. Democrats also resented the partisan process in which the legislation was drafted and a lack of hearings on legislative text.
Democrats are particularly critical of provisions cutting the top individual tax bracket from 39.6 percent to 37 percent and raising the threshold for exemption from the estate tax, both of which benefit wealthy people. They also strongly oppose the cap on the state and local tax deduction, which hurts the rich but also impacts others in high-tax states such as New York, New Jersey and California.
“The state and local tax deduction alone is an assault on the livelihoods and the property values of millions of Americans,” said Rep. Jamie Raskin(D-Md.). “The doubling of the estate tax exemption is a comical giveaway to the richest people in the country. And their territoriality provision is an invitation to businesses to export jobs and to offshore their operations.”
The corporate rate cut poses a question, as Democrats have long supported a reduction — just not one as steep as the GOP bill.
“I agreed to the corporate rate deduction to 25 percent and nothing less,” said Rep. Bill Pascrell (D-N.J.).
Senate Minority Leader Charles Schumer (D-N.Y.) told reporters shortly after the tax bill’s passage that he thinks most of the law should be revamped.
“There are probably a small number of provisions we might not repeal,” he said. “It certainly would need drastic overhaul aiming it at the middle class, not the wealthy and powerful.”
Pelosi acknowledged Democrats will need to retake the House to have any chance of repealing and replacing the tax law.
“It may have to be a ‘replace and repeal’ — replace them and repeal the bill,” she said.
But Pelosi also said that, to endure, any tax reforms should be bipartisan. And she left the door open for a low corporate tax rate.
Liberal activists are also getting involved. The Not One Penny coalition has organized a series of events making the case for the need to repeal the “most harmful” provisions in the new law. Several Democratic politicians have participated or are planning to participate in the group’s events, including Pelosi, Rep. Debbie Wasserman Schultz (Fla.) and Rep. Katherine Clark (Mass.).
Not One Penny spokesman Tim Hogan said Democrats should hit Republicans hard on the tax law in the midterms and work on repeal moving forward.
“It would be wise for Democrats to continue the fight and show that they will do what they can to make sure the economy works for everyone, not just the wealthiest,” he said.
Rep. Sandy Levin (D-Mich.), a senior member of the House Ways and Means Committee, suggested Democrats should be careful not to over-promise. Just as the Republicans had no chance of passing Affordable Care Act repeal while Obama was in the White House, he cautioned, the Democrats face near impossible odds of repealing the Republicans’ tax reforms while Trump holds the veto pen.
“It’s important for us to take back the House and the Senate so we can make that effort,” Levin said. “[But] as long as the president is the president, we’re not going to have two-thirds to override a veto.”

In a recent sermon, Abbas' advisor stated that "this nation will awaken and uproot evil from its land."

Although Al-Habbash did not specifically mention Israel in this particular part of his sermon, his prior statements were about Israel and the US' recognition of Jerusalem as Israel's capital. Right before his promise that "evil" will be uprooted, Al-Habbash mocked the US for thinking the world would support his declaration on Jerusalem: 


"The entire world has recently had its say in the face of the oppression and arrogance that the American administration is attempting to impose on us and on the world. The world is not for sale or purchase. The world's honor is not for sale... The world said: 'No.' We send our greetings to the peoples of the world that stood with the Palestinian right. We send our greetings to the states, governments, figures, and organizations that stood with the Palestinian right... As for those who have sold themselves cheaply - there is still room on the trash heap of history."

That Al-Habbash refers to Israel as "the evil" is not news. Palestinian Media Watch has exposed that Al-Habbash teaches that Israel is "Satan's project" and believes that Jews represent "evil."
