Attorney General Merrick Garland is in desperation mode.

Now he’s looking for the courts to save him from a major setback.

And Clarence Thomas was blindsided when Merrick Garland hit him with this shocking demand.Texas has been forced to step up and try to secure its border because President Joe Biden refuses to enforce the country’s immigration law.

As part of its border security operation, Texas placed razor wire along the border.

The Biden regime is hell-bent on dismantling any semblance of border security so federal authorities were ordered to cut through the razor wire.

Texas sued the Biden regime to stop them from cutting the wire and accused the federal government of illegally destroying state property.

The U.S. Court of Appeals for the Fifth Circuit sided with the state and blocked the Biden regime from cutting the wire.

“The public interest supports clear protections for property rights from government intrusion and control,” Judge Kyle Duncan wrote for a Fifth Circuit panel.The Biden regime wasn’t ready to give up its scheme to keep the border wide open.

The Department of Justice filed an emergency motion with the Supreme Court asking them to overturn the appeals court ruling.

Solicitor General Elizabeth Prelogar argued that Department of Homeland Security Secretary Alejandro Mayorkas has “the power and duty to control and guard the boundaries” of the country.

She claimed that the razor wire was impeding “agents’ ability to apprehend and inspect migrants under federal law.”

“In court papers, U.S. Solicitor General Elizabeth Prelogar argued that Congress had given the Border Patrol extensive power to enforce immigration law within 25 miles of the border, including the right to enter private property without a warrant. State governments, she wrote, have no power to displace federal authority the Constitution commits to Washington,” the Wall Street Journal reported.Texas Governor Greg Abbott fired back at the Justice Department on social media.

“Biden begs SCOTUS to let him cut razor wire TX installed on border,” Abbott wrote. “See you in court. Americans & courts will reject Biden’s hostility to immigration laws. TX will continue to deploy National Guard to build border barriers & repel illegal immigrants.”

This is the latest skirmish between Texas and the Biden regime over the state building border barriers.

Texas deployed buoy barriers in the Rio Grande River separating Texas and Mexico to keep illegal aliens from swimming across. A federal court sided with the Biden regime and ordered Texas to remove the floating barrier.

States will have to fight Joe Biden tooth and nail to secure their border.
