Why are sanctuary laws legal?

Q: Why are states and cities with "sanctuary laws" in place not practicing "nullification" like the southern states did after the passage of the 14th Amendment? Why doesn't the Supreme Court rule "sanctuary" status unconstitutional? — David

A: This is a great point, but sanctuary laws aren’t labeled “nullification” because cities aren’t blocking federal agents outright. Rather, they’re exploiting a loophole that lets them refuse cooperation.

But that refusal still sabotages federal immigration enforcement, and the Supreme Court could close the loophole by ruling that cities must cooperate when their obstruction materially weakens federal law. Whether they will do that or not remains an open question.
