Red states are fed up with Joe Biden opening up the border to an historic surge of illegal immigration.

Texas took action and Joe Biden was hopping mad.

And now Joe Biden hit Texas with one ultimatum about the border that will end up before the Supreme Court. The state of Texas is ground zero for the border crisis.

Even moderate RINOs like Governor Greg Abbott understand that citizens are demanding the state government take action to secure the border if Joe Biden refuses.

To that end, Texas put up a floating barrier in the Rio Grande, which included razor wire to try and deter illegal aliens from crossing into Texas.

The Department of Justice issued a deadline for Texas to remove the barrier.Abbott wrote back, “Texas will see you in court,” and refused to remove the barrier.

“If you truly care about human life, you must begin enforcing federal immigration laws,” Abbott wrote.

“By doing so, you can help me stop migrants from wagering their lives in the waters of the Rio Grande River. You can also help me save Texans, and indeed all Americans, from deadly drugs like fentanyl, cartel violence, and the horrors of human trafficking. To end the risk that migrants will be harmed crossing the border illegally, you must fully enforce the laws of the United States that prohibit illegal immigration between ports of entry,” Abbott’s letter added.

And court is exactly where this case is headed.

The Department of Justice responded by suing Texas to remove the barrier and keep the border fully open. “We allege that Texas has flouted federal law by installing a barrier in the Rio Grande without obtaining the required federal authorization,” Associate Attorney General Vanita Gupta declared. “This floating barrier poses threats to navigation and public safety and presents humanitarian concerns. Additionally, the presence of the floating barrier has prompted diplomatic protests by Mexico and risks damaging U.S. foreign policy.”

“The Rivers and Harbors Act is clear in prohibiting the placement of any unauthorized barriers or obstructions in the Rio Grande and other navigable waters of the United States,” Assistant Attorney General Todd Kim of the Justice Department’s Environment and Natural Resources Division ranted. “We intend to seek the appropriate legal remedies, including the removal of such obstructions in the Rio Grande.”

This case is likely to go all the way to the Supreme Court as whoever loses will appeal.

Biden wants to retain the unilateral authority to keep the border open and red states want a check on Biden’s lawlessness.
